Guarantee and Refund Policy
Baycrest Systems. Effective Date: November 3, 2026
This policy covers what you pay Baycrest and when you can get it back. It sits alongside your service agreement. If the two conflict, your service agreement controls.
1. What you pay
1.1 Setup fee. A one-time fee for building your intake, qualification and routing. It is not refundable once setup work starts, except under the 30-day guarantee in section 2.
1.2 Per-consult fee. You pay for each attended qualified consult, as defined in section 3. You do not pay for a consult that does not meet that definition.
1.3 Ad spend. You pay it directly to Google or Meta, not to Baycrest. See section 5.
2. 30-day guarantee
2.1 If we deliver fewer than 15 attended qualified consults in the first 30 days after your ads first go live, we refund your setup fee in full. Ad spend is never refunded. Per-consult fees for qualified consults we did deliver still apply.
2.2 The 30 days start when your ads go live, not when you sign.
2.3 The guarantee applies only if you meet all of these conditions.
2.4 You keep the minimum monthly ad spend in your service agreement running for the full 30 days.
2.5 You answer and take the consults at the booked times.
2.6 You do not change your case types, your state or province, or your time window during the 30 days unless we agree.
2.7 You ask for the refund in writing at mark@baycrestsystems.com within 14 days after day 30.
2.8 We pay the refund within 14 days of approving it.
2.9 Each firm gets one guarantee, for its first 30 days only. Adding an office later, or signing a new agreement, does not start a new one.
2.10 Getting the refund does not change the rest of your service agreement.
3. What counts as a qualified consult
A consult counts, and is billable, only when all eight of these are true:
- The person came through a campaign we run and track, and had not contacted your firm in the last 90 days from any other source.
- The case type is on the list your firm picked.
- The incident is inside your time window: 2 years by default, or the statute of limitations if shorter.
- The person is in your state or province.
- The person says they have no other lawyer.
- The person reports an injury.
- Our intake spoke with them and they confirmed a specific time on your calendar.
- The person attended the consult.
We count consults from Baycrest's tracking, our call recordings and your booking calendar.
4. Disputes, no-shows and cancellations
4.1 You have 48 hours after we report a consult to reject it. You can reject it only for a reason on the list in section 3. The recorded call or transcript is the evidence.
4.2 A consult you reject for a valid reason is not billed and does not count toward the 15.
4.3 A no-show is not billed and does not count toward the 15.
4.4 If your firm cancels, or does not call at the booked time, the consult is billed and counts toward the 15.
5. Ad spend
5.1 Ad spend is paid directly to Google or Meta. We cannot refund it, and the guarantee in section 2 never covers it. Any refund of ad spend is up to the platform.
6. Billing mistakes
6.1 If we charge you in error, such as a duplicate invoice, tell us at mark@baycrestsystems.com and we will correct it.
7. Results
7.1 The 30-day guarantee in section 2 is the one exception to this section. Beyond it, Baycrest does not promise any result. We guarantee consults, not case outcomes. We do not promise that any person will hire your firm, that you will accept any case, or that any matter will end in a recovery. We do not give legal advice.
